Terms of Service

These Terms apply to all users worldwide. Additional rights for EU/EEA consumers are set out in Section 13. Please read these Terms carefully before using the Service.

1. Acceptance

By creating an account or using SiteScanFix (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Manoj (“we”, “us”), registered in India.

2. Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Service.
  • If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
  • Users in the United States under the age of 13 are not permitted to use the Service. See our Privacy Policy (Section 11) for our children's data practices.
  • The Service is available globally, subject to applicable export and sanctions laws (Section 12).

3. Acceptable use

You may use the Service only to audit websites you own or for which you have explicit written permission from the owner. You must confirm this before every scan. You must not:

  • Scan websites without the owner's permission.
  • Use the Service to conduct active attacks, probe for live exploits, exfiltrate data, or cause harm to any third-party system.
  • Attempt to circumvent rate limits, quotas, scan consent requirements, or authentication mechanisms.
  • Resell, sublicense, or white-label the Service or its reports without our prior written consent.
  • Use automated scripts, bots, or scrapers to access the Service in a manner that exceeds normal human usage.
  • Upload, submit, or link to URLs that are unlawful, harmful, or designed to compromise our infrastructure (e.g., SSRF payloads — our systems will reject these).
  • Use the Service in any way that violates applicable law, including the Indian IT Act 2000, the DPDP Act 2023, GDPR, the Computer Fraud and Abuse Act (US), or the Computer Misuse Act (UK).

Violation of these rules may result in immediate account suspension without refund and, where required by law, referral to relevant law enforcement authorities.

4. Plans, billing and cancellation

  • Free plan: 3 scans lifetime. Limited to Performance and SEO scanners. No credit card required.
  • Paid plans (Starter, Pro, Agency): Monthly subscriptions billed in advance via Razorpay. Prices are displayed in Indian Rupees (INR) and include applicable taxes. We accept major debit/credit cards and UPI.
  • Auto-renewal: Subscriptions renew automatically on the same day each month until cancelled.
  • Cancellation: You may cancel at any time from your account dashboard. Access to paid features continues until the end of your current billing period. No partial refunds are issued for unused time, except as required by law.
  • Refund policy: Payments are generally non-refundable. If you experience a billing error or a significant service outage attributable to us, contact support@sitescanfix.com within 7 days and we will review your request.
  • Price changes: We will give at least 30 days' notice before increasing subscription prices. Continued use after the effective date constitutes acceptance of the new price.

5. AI-generated content

AI summaries, fix prompts, and remediation plans are generated by Google Gemini and are provided for informational and advisory purposes only. They are not a substitute for professional security, legal, or engineering advice. We make no warranty that AI-generated content is complete, current, or appropriate for your specific circumstances.

You are solely responsible for evaluating and implementing any AI suggestions. Always review output and test changes in a staging environment before deploying to production. AI output may occasionally be incorrect or incomplete — treat it as a starting point, not a definitive answer.

6. Scan results and accuracy

Scan results represent a point-in-time snapshot of the scanned URL at the time of the scan. They may not reflect your site's current state and should not be treated as a continuous monitoring service unless you run repeated scans.

Performance and accessibility scores are sourced from Google PageSpeed Insights and may vary by ±5–15 points between scans due to network and server conditions — this is a known characteristic of Lighthouse and is documented by Google. We make no guarantee that the scan detects every vulnerability or compliance issue. The Service is a diagnostic aid, not a security certification.

7. Intellectual property

The Service, including its software, user interface, design, and branding, is owned by Manoj and protected by applicable intellectual property laws worldwide. You retain full ownership of the websites and data you submit for scanning.

You grant us a limited, non-exclusive, royalty-free licence to process your submitted URLs and scan results solely to provide the Service. We do not use scan results to train AI models or share them with third parties beyond what is described in our Privacy Policy.

8. Disclaimer of warranties

The Service is provided “as is” and “as available” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted and error-free operation. We do not warrant that the Service will detect all security vulnerabilities, GDPR risks, or performance issues on any website.

Note: Some jurisdictions (including the EU) do not allow the exclusion of implied warranties in consumer contracts — to the extent such exclusions are not permitted, they do not apply to you.

9. Limitation of liability

To the maximum extent permitted by applicable law, SiteScanFix and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, business opportunity, or reputation — even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising from these Terms shall not exceed the greater of (a) the total amount you paid us in the 3 months preceding the claim, or (b) ₹500.

Note: EU/EEA and UK consumer law may provide rights that cannot be excluded or limited by contract. Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Manoj and its officers from any claim, damage, or expense (including reasonable legal fees) arising from your breach of these Terms, your use of the Service in violation of applicable law, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your account immediately if you breach these Terms, engage in conduct that harms other users or the integrity of the Service, or if required to do so by applicable law. We will give you notice where legally or practically possible.

You may delete your account at any time from the dashboard. This permanently and immediately erases all your scan data, reports, and account information in accordance with our Privacy Policy.

12. International use and export compliance

The Service is hosted on infrastructure based in the United States and India. By using the Service from any country, you are responsible for compliance with your local laws. You represent that you are not located in a country subject to a US Government embargo or trade sanction, and that you are not on any US Government restricted-party list.

13. Additional rights for EU / EEA and UK consumers

If you are a consumer residing in the European Union, European Economic Area, or United Kingdom, you have additional statutory rights that these Terms cannot override:

  • 14-day right of withdrawal: For subscriptions, you have the right to withdraw from the contract within 14 days of purchase without giving any reason (EU Consumer Rights Directive). You may lose this right if you have already used the Service (i.e., run at least one scan) during the withdrawal period — by starting a scan, you expressly consent to immediate performance and acknowledge that the withdrawal right is lost to that extent.
  • Conformity: Digital services must conform to the contract. If the Service does not work as described, contact us and we will make reasonable efforts to remedy the issue.
  • Unfair terms: Any term in these Terms that is found to be unfair under applicable consumer law will not be binding on you.
  • Online dispute resolution: EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr. Our email for ODR purposes: support@sitescanfix.com.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

Before initiating legal proceedings, both parties agree to attempt informal resolution by contacting support@sitescanfix.com and allowing 30 days for a response. This clause does not limit rights you may have under mandatory consumer protection laws in your jurisdiction.

15. Changes to these Terms

We will notify registered users by email at least 14 days before any material changes take effect, and update the “Last updated” date above. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, you may close your account before the effective date.

16. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
